Welcome to Guhemba

By opening and using a Guhemba account, you agree to comply with all of the terms and conditions in this user agreement. Below Terms of Service and Privacy are for ‘Ikawa Launch’ and these terms will be updated as we fully launch the services in the future.

Opening a Guhemba Account

User must be 18 years or older. 

You are responsible for maintaining adequate security and control of any and all IDs, passwords, personal identification numbers, or any other codes that you use to access your Guhemba account and the Guhemba Payment Service. You must keep your phone number, email address and other contact information current in your Guhemba account profile.

Account Limit. Guhemba limits the number of Accounts that may be created to one account per person. You agree that you will not:

• Create an account for anyone other than yourself without such person's permission;

• Create a username (“@Name” or First, Second Name) that is the name of another person with the intent to impersonate that person; 

• Create a user name or Murugo Cloud account that is subject to any rights of a person other than you without appropriate authorization; or

• Create a user name that is a name that is otherwise offensive, vulgar or obscene or otherwise unlawful.

Guhemba is part of the Murugo Cloud Ecosystem and uses the Murugo User and Murugo Authentication Services. All Terms and Policies of the Murugo Cloud apply.

‘Ikawa Launch’ Restrictions

 

May of 2021, Guhemba launched with limitations and disabled features to comply with the Central Bank regulations. The Guhemba payment system for the Ikawa Launch period will be limited to one merchant, ‘Ikawa Cafe’ located in the Rwanda Build Program Tech Labs (Impact Hub Building “the office” in Kiyovu, Kigali, Rwanda)

All transfers of money are pre-paid purchases or real-time purchases to Ikawa Cafe and in no way money is to be considered in holding or belonging to the end users customer. Any transfer of money is pre-paid purchases to Ikawa and non-refundable. 

Privacy

 

By using the Services, you consent to Guhemba and Murugo Cloud’s collection, use, and disclosure of information about you and your device. Please refer to both Privacy Policies for information about how we collect, use and disclose information about you and your mobile device. Please review our data collection practices carefully before using our Services

Personal information is not shared to 3rd parties or advertisers. Both Guhemba and the Murugo Cloud will not sell or distribute user personal information including purchases or other user activity to any 3rd party. 

 

User has to option to share, sync, and create contacts in Guhemba. Only upon user approval can this information be used or shared. Guhemba and Murugo Cloud has the ability to sync contacts upon the approval and request of the end user who has uploaded or created the contact record. No contact information is shared with 3rd parties or advertisers. 

Fraud or Non-Lawful Behavior

Any and all use of Guhemba to defraud anyone or any business, or break any laws will be subject to the laws of Rwanda or any other country, state, city. Unconditionally, we will comply with the laws of Rwanda to pursue anyone that uses the Guhemba service to defraud anyone or break any laws. Users who use Guhemba unlawfully or break our terms of service have no protection or rights within the Guhemba services. 

Mobile Use. 

If you use a mobile device, please be aware that your carrier's normal rates and fees, such as text messaging and data charges, will still apply. In the event you change or deactivate your mobile telephone number, you agree that you will update your account information on the Services within 48 hours to ensure that your messages are not sent to the person who acquires your old number.

Other User Data

You and your account must not collect users' content or information, or otherwise access Murugo Cloud, using automated means (such as harvesting bots, robots, spiders, or scrapers) without written permission from Murugo Cloud.

Availability of the Service. 

The Service, or any feature or part thereof, may not be available in all languages or in all countries and Guhemba Ltd. makes no representation that the Service, or any feature or part thereof, is appropriate or available for use in any particular location. To the extent you choose to access and use the Service, you do so at your own initiative and are responsible for compliance with any applicable laws.

Limitations on Use.  

You agree to use the Service only for purposes permitted by this Agreement, and only to the extent permitted by any applicable law, regulation, or generally accepted practice in the applicable jurisdiction. Your Account is allocated limited storage. Additional storage is available for purchase upon request. If your use of the Service or other behavior intentionally or unintentionally threatens Guhemba’s ability to provide the Service or other systems, Guhemba Ltd. shall be entitled to take all reasonable steps to protect the Service and Guhemba’s systems, which may include suspension of your access to the Service. Repeated violations of the limitations may result in termination of your Account. 

Changing the Service.  

Guhemba Ltd. reserves the right at any time to modify this Agreement and to impose new or additional terms or conditions on your use of the Service.

Termination (Ikawa Launch Terms).

Guhemba Ltd. may terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately, which may result in the forfeiture and destruction of all information associated with the Services. If you wish to terminate your account, you may do so by following the instructions on the Guhemba web site. Any fees (if any) paid hereunder are non-refundable. All provisions of these Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Warranty Disclaimer.

Guhemba Ltd. has no special relationship with or fiduciary duty to you. You acknowledge that Guhemba Ltd. has no control over, and no duty to take any action regarding: which users gain access to the Services; what Content you access via the Services; effects, if any, the Content may have on you; how you may interpret or use the Content; or what actions you may take as a result of having been exposed to the Content.

 

You release Guhemba Ltd. from all liability for you having acquired or not acquired Content through the Services. The Services may contain, or direct you to websites containing, information that some people may find offensive or inappropriate. Guhemba Ltd. makes no representations concerning any Content contained in or accessed through the Services, and Guhemba Ltd. will not be responsible or liable for the accuracy, copyright compliance, legality or decency of material contained in or accessed through the Service.

 

You release us from all liability relating to your connections and relationships with other users of the Sites. You understand that we do not, in any way, screen users, nor do we inquire into the backgrounds of users or attempt to verify their backgrounds or statements. We make no representations or warranties as to the conduct of users or the veracity of any information users provide. In no event shall we be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the conduct of you or anyone else in connection with the Services, including, without limitation, bodily injury, emotional distress, and any damages resulting in any way from communications or meetings with users or persons you may otherwise meet through the Services. As such, you agree to take reasonable precautions and exercise the utmost personal care in all interactions with any individual you come into contact with through the Services, particularly if you decide to meet such individuals in person. For example, you should not, under any circumstances, provide your financial information (e.g., credit card or bank account numbers) to other individuals.

 

THE SITE, SERVICE, CONTENT ARE PROVIDED "AS IS", "AS AVAILABLE" AND ARE PROVIDED WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED, SAVE TO THE EXTENT REQUIRED BY LAW.

 

Guhemba Ltd., AND ITS DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, SUPPLIERS, PARTNERS AND CONTENT PROVIDERS DO NOT WARRANT THAT: (A) THE SERVICES WILL BE SECURE OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (C) ANY CONTENT OR SOFTWARE AVAILABLE AT OR THROUGH THE SERVICES IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICES WILL MEET YOUR REQUIREMENTS. YOUR USE OF THE WEBSITE, SERVICES, CONTENT IS SOLELY AT YOUR OWN RISK. SOME STATES / COUNTRIES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
